Terms of Service
Effective date: October 15, 2026
These Terms of Service describe the conditions for using the websites, Shuffll Engage, video creation and personalization services, APIs, MCP connections and related services offered by Shuffll Inc. (“Shuffll”, “we”, “us”). By using the Services, you agree to the terms applicable to that use. If you act for an organization, you must have authority to bind it. Questions can be sent to [email protected].
1. Your service agreement comes first
A separate signed service agreement, order form, data processing agreement or other written agreement with Shuffll controls the subjects it covers and takes priority over conflicting provisions on this page. These public terms do not replace a negotiated customer agreement or expand the permissions granted under it. Features, commercial terms, support commitments and service levels are those agreed for your account.
2. Accounts and authorized access
Use accurate account information and protect your credentials. You are responsible for the users, integrations and agents you authorize to act for your organization and for configuring appropriate access. Do not share credentials with unauthorized parties, bypass access controls, access another customer’s data, interfere with the Services or exceed applicable usage limits. Report suspected credential compromise promptly.
Some features are limited by account entitlements, permissions, availability and technical configuration. A feature description, MCP tool or marketplace listing does not by itself grant access, guarantee a platform approval or promise that a feature is available in every environment.
3. Customer content and permitted processing
You retain your rights in the material you supply, including brand assets, product and audience data, prompts, scripts, images, recordings and other content. You must have the rights, permissions and lawful basis necessary for Shuffll and its providers to process that material for your requested use. This includes permission to use a person’s name, likeness or voice where required.
You authorize Shuffll and the service providers used for your configuration to host, copy, process, transform, render and transmit your content as needed to provide, secure and support the Services and carry out your authorized instructions, subject to the applicable agreement. This is not a transfer of ownership in your content. Information handling and permitted service improvement, including use of aggregated or effectively de-identified operational information for orchestration models, are described in our Privacy Policy. These terms do not grant an additional right to use raw or identifiable customer content for shared-model training without separate authorization.
4. AI-generated material and review
AI-generated text, images, audio, video and recommendations can be inaccurate, incomplete, unsuitable or similar to material generated for others. Review previews and final outputs before use, including names, prices, eligibility, offers, factual claims, visual and voice rights, and any required disclosures. Do not treat generated material as professional advice or an independently verified statement.
Your rights to outputs depend on the applicable service agreement, provider terms, third-party materials and law. Shuffll does not guarantee that every output is unique, eligible for intellectual-property protection or free of all third-party rights. You are responsible for how you publish or use outputs.
5. Acceptable use
Do not use the Services for unlawful, deceptive, abusive or infringing activity, unauthorized impersonation, non-consensual intimate content, malicious code, credential theft or unauthorized surveillance. Do not submit regulated or particularly sensitive information unless your agreement and configuration expressly support that use. You must comply with applicable privacy, intellectual-property, consumer-protection and communications laws and the policies of any connected platform. Authorized security testing must follow the scope agreed with Shuffll.
6. APIs, MCP and agent actions
Applications and agents connected through an API, MCP or webhook can read information or perform actions within their approved permissions. Review the organization, scopes and capabilities before authorizing a connection. A prompt to an agent may lead to operations, resource consumption or disclosure of tool results to that agent’s service. Configure access and spending controls accordingly.
Use the documented interfaces, required operation identifiers and revision controls. Do not assume that disconnecting an agent reverses operations it has already completed or deletes information it has already received. Third-party chat services, marketplaces, CRMs and other connected systems have their own terms and privacy policies; Shuffll does not control those services or their approval decisions.
7. Campaigns and delivery
You determine your campaign audience, message and lawful basis for contacting recipients. Obtain required permissions, honor opt-outs and suppression requirements, and follow the rules applicable to SMS, WhatsApp and other channels you enable. You are responsible for the accuracy of personalization data, audience eligibility and claims about benefits, discounts or offers.
Connecting a client, drafting a campaign or generating a preview does not by itself launch a campaign. Delivery requires the applicable configuration, permissions and authorization. Test with appropriate destinations and review the content and expected cost before launching. Carrier, platform and recipient restrictions can affect delivery; successful submission to a provider does not guarantee receipt, viewing or a particular business result.
8. Fees and usage
Prices, usage allowances, billing, renewals, cancellations and any refund rights are governed by your order, selected plan or written agreement. Generation, rendering, exports and message delivery may consume allowances or incur charges under those terms, including when an authorized integration initiates them. Do not assume that retries, revisions or tests are free. Contact us if the cost or authorization for an operation is unclear.
9. Service operation and third parties
We may maintain, change or restrict the Services to operate them, address security or abuse, comply with law or manage third-party dependencies, subject to any commitments in your service agreement. Availability and results can be affected by external providers. Unless separately agreed, development, preview and beta features may change and do not carry a production service-level commitment.
10. Responsibilities and applicable protections
Shuffll’s warranties, service commitments, liability limitations and remedies under a written customer agreement continue to apply. We do not promise uninterrupted operation, error-free AI outputs, guaranteed campaign performance or that the Services alone make your activities legally compliant. Nothing on this page excludes rights, remedies or liability that cannot lawfully be excluded or limited.
11. Ending access and handling data
Termination and account closure follow the applicable agreement. You may request disconnection, revocation, export or deletion through available controls or by contacting us. These are distinct actions: revoking an integration does not automatically delete projects or recall delivered media. Retention, backup handling and legal or security recordkeeping are described in the Privacy Policy and any applicable data processing agreement.
12. Updates and contact
We may update these terms and will identify the updated date. Material changes will be communicated, and additional agreement obtained, where required. Updates do not override an existing written agreement or retroactively authorize uses of customer content that require separate permission.
